KS yang mengetahui pernikahan suaminya tersebut kemudian membawa kasus ini ke meja hijau. Kasus ini disidangkan di Pengadilan Negeri (PN) Negara, Senin (8/7) dengan agenda keterangan saksi.

Dalam keterangannya sebagai saksi persidangan, AKS mengungkapkan jika dia baru mengetahui jika suaminya menikah lagi, sejak PS dibawa ke rumah mertuanya, yang hanya berjarak beberapa meter saja dari rumahnya. 

"Saya baru tahu sejak dibawa ke rumah Agustus 2018 lalu. Sudah hampir setahun tinggal bersama-sama," kata AKS kepada Ketua Majelis Hakim Haryuning Respanti, seperti dikutip dari Kompas. com.

AKS yang telah menikah dengan KG sejak tahun 2000 itu juga mengatakan jika dirinya tidak pernah memberi suaminya izin untuk menikah lagi.

"Saya tidak pernah memberi izin. Saat pulang saya tanya, ngomongnya sudah nikah lagi. Saya sangat marah. Tapi saya tidak mau cari ribut, kasihan sama mertua sudah tua," jelasnya.

KG dan PS dinikahkan secara adat oleh LPS, bibi KG yang tinggal di Yehsumbul, tak jauh dari rumahnya. LPS pun juga bersaksi jika sebelum menikahi PS, KG mengatakan jika dia telah meminta izin istri pertamanya.

"Saya didatangi sama dia (KG). Kan dia sepupu saya. Terus ngomong mau ambil istri (nikah lagi). Saya tanya, sudah minta izin. Katanya waktu itu, sudah minta izin," jelas LPS.

Meski begitu, LPS tidak pernah berbicara dengan AKS untuk memastikan bahwa KG telah meminta izin.

"Iya saya tidak sempat ngomong ke istrinya. Kan itu ponakan saya. Jadi saya percaya saja. Sekarang tahu kalau belum minta izin," kata LPS.

Seorang saksi ahli pernikahan yang juga Ketua PHDI Jembrana, I Komang Arsana, menyatakan jika pernikahan antara KG dan PS sah.

"Kalau pernikahannya karena sudah menggelar Dewa Saksi, maka sah," tegasnya.

Hanya saja, lanjut Arsana, dalam perkawinan lebih dari satu baru bisa dilakukan jika istri atau suami sakit keras, istri tidak bisa memberikan keturunan, dan yang ketiga mendapat persetujuan dari istri pertama.

"Kalau tidak ada izin itu pelanggaran," tegasnya

Akibat hal itu, terdakwa terjerat pidana umum pasal 279 ayat 1 KUHP tentang perkawinan. Yang membuat keduanya bisa terancam hukuman penjara.
